Microsoft Corp's (NASDAQ: MSFT) exclusive 'Gears of War' remake has been leaked by beta testers. According to Kotaku, beta testers hired by VMC have released videos about the remake and have been punished with a ban on their Xbox Live accounts. VMC was quoted as saying: “Microsoft also permanently disabled their (leakers) Xbox LIVE accounts (as well as other suspected accounts present on their Xbox One kits) and temporarily blocked all of their Xbox One privileges – meaning that for a period of time which Microsoft decides depending on the severity of the offense, their Xbox One is entirely unusable.”
It seems like Microsoft took swift action to protect its intellectual property. However, it seems that the action caused Xbox One consoles owned by the banned beta testers to brick. Kotaku quoted a statement from Microsoft denying any such reports: “To be clear, if a console is suspended from Xbox Live for a violation of the Terms of Use, it can still be used offline. Microsoft enforcement action does not result in a console becoming unusable. Suspensions for both consoles and accounts are determined by looking at a number of factors. To avoid enforcement action including suspension from the service, users should follow the Xbox Live Terms of Use and Code of Conduct.”
It is true that the Xbox One may not be bricked if banned from Xbox Live. However, Xbox Live is required to download patches for smooth running of certain games. At the same time, games like Destiny require online access. So while the Xbox One consoles may not have suddenly stopped working, revoking access to Xbox Live does have huge consequences.
It does seem that we could be heading to a digital-only future where online access will be a standard rule. Even though Sony Corp (ADR) (NYSE: SNE) stood by its consumers and allowed the PlayStation 4 to be open in terms of online access and resale of physical discs. The PS4 does not require online access for any games, except for Destiny and other such Internet-based titles. At the same time, there are no restrictions on usage of physical discs. Similarly to the Xbox One, the PS4 also requires the Internet to download patches and access DLC and, most importantly, a PlayStation Network membership. PlayStation Plus is required for online multiplayer, which is a paid subscription.
At the end of the day, Microsoft has rights over unreleased games and what it needs to reveal to the public before the street date. Beta testers more than likely have to sign confidentiality agreements as well. Gears of War is one of their biggest franchises and some beta testers must have wanted to stir some excitement on the game and hence leaked videos. Microsoft did what it had to do and it felt that revoking its right to the Xbox Live service was the best punishment. It would not affect the working of the Xbox One console since Microsoft had long before removed the online-only option before launch.
